The following Limited Warranties are granted only to the end customer, subject to all of the terms and conditions set forth below. These Limited Warranties are non-transferable:

Subject to all limitations and exclusions set forth in these Limited Warranties, Ashley Furniture Industries, Inc. (hereinafter “Ashley”) warrants the following Ashley products and parts against all material manufacturing defects for the duration indicated for the respective products or parts in the table below.

  • Bedspreads or Duvets
    Bedspreads refer to comforters, bed skirts, throw pillows, and all types of decorative pillows and cushions that are included in a bedspread set.

  • Finishes and other furniture products
    This category refers to all finishes and other furniture parts, components, and other products that are not specifically included in the Limited Warranties mentioned above, including, but not limited to, dining tables, chairs, end tables, beds, dressers, sofa bed mattresses, marble-topped bureaus, granite-topped bureaus, desks, display cabinets, display cases, entertainment centers, lamps, electrical components (other than light bulbs), and recliner handles that are incorporated into each furniture product.

*As used in these Limited Warranties, refers to normal use of the product under reasonable operating circumstances.

**After the first year of use, Ashley will replace the sofa bed mattress on the following prorated basis: for use of more than 1 year but less than 2 years, 80% of the replacement cost is covered; for use of more than 2 years but less than 3 years, 50% of the replacement cost is covered.

***All seat cushions, both loose and fixed, will soften with normal use and their shape will conform to that of the user. This will be considered normal wear and tear and will not be treated as a loss of elasticity or a manufacturing defect.

****The Limited Warranty for Upholstery Fabrics and Leather also includes seam rips, fraying, and dye transfer. Leather is a natural product, and as such, each piece of leather will reflect its own individuality. Some variations in shades and tones, as well as creases and wrinkles, which occur only in genuine leather, are to be expected; these characteristics are not considered defects under any circumstances. These Limited Warranties do not cover rips or tears, nap flattening, pilling, fading, or shrinking, and are void in the event of obvious abuse or heavy soiling. These Limited Warranties also do not cover protective finishes, velvets, and flocked products, as, by their nature, these fabrics are finely textured and will crush, change color, and mark more easily than most fabrics; these characteristics are not considered defects under any circumstances.

LIMITATIONS AND EXCEPTIONS

The following limitations and exceptions apply to the Limited Warranties:

Resource

  • Under these Limited Warranties, for all products except Loose Cushions (as defined under the heading “Cushions” above), Ashley’s sole liability is limited to the repair or, at its option, replacement of the respective product or part that fails to conform to these Limited Warranties. NO REFUNDS OR REFUNDS ARE ACCEPTED. Within the warranty period, if identical materials are not available at the time of repair or replacement, Ashley reserves the right to substitute materials of identical or superior quality. Replacement fabrics may vary in color from the original due to differences between paint batches.
  • In addition, during the period of any applicable Labor Coverage, Ashley will pay, within one year of the date of purchase, reasonable and customary labor rates for the repair or replacement of defective parts (at Ashley's option) and shipping costs from the retailer to and from Ashley, at no cost to the end-customer. After the Labor Coverage expires, or for all products or parts not covered by such coverage, the original retail purchaser will be responsible for all labor, packaging, shipping, and transportation costs. Costs associated with transporting furniture or parts from your home to the retailer or from the retailer to your home are excluded from all Limited Warranties.
  • For loose cushions with a material manufacturing defect, Ashley will replace the defective cushion provided that the end-user customer does the following during the warranty period: (i) comply with the Claims Process outlined in these Limited Warranties and (ii) upon Ashley's request, return the defective loose cushion to Ashley Furniture Industries, Inc., Attn: Director of Quality, One Ashley Way, Arcadia, WI 54612. The remedy specified in this paragraph represents Ashley's sole liability with respect to loose cushions.
  • Any item repaired or replaced under these Limited Warranties will be covered under these Limited Warranties only for the remainder of the original warranty period.

All products

These Limited Warranties do not apply to (i) rental, commercial, business, institutional, or other non-residential uses, (ii) products that have, at any time, been used as display items or trade shows, (iii) any products purchased “as is” or secondhand, (iv) any products acquired through a fire sale or going-out-of-business liquidation, (v) any products purchased from a liquidator, or (vi) items obtained through a rental business. All warranties, whether express or implied, cover normal household use only. No warranty, whether express or implied, applies to any conditions arising from misuse, abuse, damage in delivery or transportation, or any conditions arising from improper or inadequate maintenance, cleaning, or care. These Limited Warranties are null and void if the furniture is moved from the original point of delivery to the consumer.

Chemical treatments

These Limited Warranties do not cover damage or defects caused by the use of chemical treatments or protective coatings on the finish, leather, or upholstery fabrics by the retailer or original retail purchaser, and all such chemical treatments or protective coatings void all warranties made by Ashley.

Leather, upholstery fabric and finishes

The Limited Warranties for “Leather,” “Upholstery Fabric,” and “Finishes and All Other Furniture Products” do not cover (i) damage due to excessive soiling, improper or unauthorized cleaning methods, (ii) fading or other damage due to exposure to sunlight, (iii) damage due to moisture existing in the home, or (iv) damage due to any liquid, including, but not limited to, alcohol and water. ATTENTION: Any use of improper or unauthorized cleaning methods voids all warranties provided by Ashley.

Modifications to products

These Limited Warranties do not apply to any product that has been modified by any person, dealer, or company without Ashley's express written authorization.

Implied warranties

ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IMPOSED UNDER STATE LAW ON THE SALE OF THIS FURNITURE AND ITS PARTS, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD, AFTER WHICH NO WARRANTY WILL APPLY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

LEGAL NOTICE

NO OTHER EXPRESS WARRANTY HAS BEEN GIVEN OR WILL BE GIVEN ON BEHALF OF ASHLEY WITH RESPECT TO THE FURNITURE AND ITS RESPECTIVE PARTS OR THE OPERATION, REPAIR, OR REPLACEMENT OF SUCH FURNITURE AND ITS COMPONENTS. FURTHERMORE, NO REPRESENTATIVE OF ASHLEY OR ITS DISTRIBUTORS OR RETAILERS IS AUTHORIZED TO MAKE ANY MODIFICATIONS OR CHANGES IN THESE LIMITED WARRANTIES.

SOME RETAILERS OFFER EXTENDED OR ADDITIONAL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, EXTENDED OR ADDITIONAL FABRIC WARRANTIES, EITHER FROM THE RETAILER OR THROUGH A THIRD PARTY. ASHLEY SHALL NOT BE LIABLE FOR ANY EXTENDED OR ADDITIONAL WARRANTIES OFFERED BY ANY RETAILER OR THIRD PARTY UNDER ANY CIRCUMSTANCES.

ASHLEY SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, SUCH AS LOSS OF USE, INCONVENIENCE, LOSS OR DAMAGE TO PERSONAL PROPERTY, WHETHER DIRECT OR INDIRECT, WHETHER ARISING IN CONTRACT OR TORT, EVEN IF ASHLEY HAD PRIOR KNOWLEDGE THAT SUCH DAMAGES WERE POSSIBLE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THIS LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

ASHLEY'S LIABILITY SHALL NOT, UNDER ANY CIRCUMSTANCES, EXCEED THE PURCHASE PRICE OF THE PRODUCT OR ITS REPLACEMENT.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

CAUTION

Furniture with movement (recliners, sofa beds, etc.) has many moving parts. Caution should be exercised when operating it (opening or closing, etc.). Children should not be allowed to play on or operate mobile furniture. Always leave reclining furniture in the closed, upright position and keep hands and feet away from the mechanism. Only the occupant should operate the furniture.

CLAIM PROCESSING

To obtain warranty service, the end customer must comply with the requirements of this Claims Procedure. Contact the Ashley dealer where you purchased your furniture to obtain warranty service. All claims must include the original purchase receipt, the product serial number, and must be completed within the current warranty period. Ashley reserves the right to require the return of defective parts at your request. You must coordinate with the dealer to transport the furniture or parts from your home to the dealer's location, or from the location to your home. If the dealer where you purchased the furniture has closed and you require warranty service, please contact Ashley in writing or call our Customer Service team.

The following Limited Warranties are granted only to the original purchaser, subject to all of the terms and conditions set forth below. These Limited Warranties are non-transferable:

Subject to all limitations and exclusions set forth in these Limited Warranties, Ashley Furniture Industries, Inc. (hereinafter “Ashley”) warrants the following Ashley products and parts against all material manufacturing defects for the duration indicated for the respective products or parts in the table below.

**Mattresses: All innerspring or specialty mattresses come with a full ten-year warranty EXCEPT children's models (memory foam, innerspring) and those with springs in the Starter range, as indicated

***Frame mechanisms include: motor, electrical wiring, all moving components and remote control.

Resource

Under these Limited Warranties, Ashley's sole liability during the applicable warranty period is limited to the repair or replacement, at its option, after inspection by an authorized Ashley representative, of the respective product or part that fails to conform to these Limited Warranties. After
The 1-year Limited Warranties for bed frames, box spring mechanism, and electrical components cover replacement parts only. No refunds or reimbursements are available. Within the warranty period, if identical materials are not available at the time of repair or replacement, Ashley reserves the right to substitute materials of identical or superior quality.

In addition, during the period of any applicable Labor Coverage, Ashley will pay reasonable and customary labor rates for the repair or replacement of defective parts (at Ashley's option) and retail shipping costs to and from Ashley, at no cost to the original retail purchaser. After Labor Coverage expires, or for all products or parts not covered by such coverage, the original retail purchaser will be responsible for all labor, packaging, shipping, and transportation costs.

Ashley is not responsible for coordinating or covering the cost of shipping the product from your home to the dealer or from the dealer to your home. You must coordinate these details with the dealer. If the dealer where you purchased the furniture has closed and you require warranty service, please contact Ashley in writing or call our Customer Service team.

Caution

The bed frame has many moving parts. Caution must be exercised when operating it. Children should not be allowed to play on or operate the bed frame. Always leave the bed frame horizontal and keep hands, feet, and other body parts away from the mechanism.

Ashley reserves the right to refuse service and void these Limited Warranties if, upon inspection, it discovers that the Ashley mattress or box spring is in an unsanitary condition or when a product failure is due to causes other than faulty workmanship or materials. See the “Mattress and Box Spring Care Instructions” section of these Limited Warranties for proper mattress and box spring care instructions.

INSTRUCTIONS FOR THE CARE OF THE MATTRESS AND BOX SPRING

TO DO

Give your new mattress time to "air out" after removing it from its box or plastic bag. Remove all plastic as soon as possible.

Carry or transfer the mattress on its side. It's easier to handle and less likely to be damaged in this position.

Keep your bedding clean. We suggest using a mattress protector, especially if the bed will be used by children.

Replace your old box spring when you buy a new mattress. Your old box spring may not provide enough support. It may seem like your new mattress has sagged, when in fact, it's the box spring that's holding up the mattress.

Use a proper frame and center support for queen-size and king-size beds. Using the correct frame will ensure your warranty remains valid.

Let your memory foam mattress warm to room temperature. Memory foam is sensitive and softens when heated.

The covers on some Ashley mattress models can be removed for washing if necessary. We recommend washing in cold water and drying on a cool setting; air drying is recommended.

WHAT NOT TO DO

DO NOT PLACE THE MATTRESS NEAR AN OPEN FLAME AND AVOID EXPOSURE TO FIRE. THIS MATTRESS IS NOT FLAME-RESISTANT OR FIRE-RESISTANT AND MAY CATCH FIRE AND/OR BURN IF EXPOSED TO AN OPEN FLAME OR FIRE. WHEN IGNITED, SOME MATERIALS ON THE MATTRESS SURFACE MAY BURN RAPIDLY AND EMIT HAZARDOUS SMOKE AND GASES.

DO NOT smoke in bed. This mattress is manufactured to meet federal law requirements to resist ignition, but not necessarily to eliminate the risk of ignition from lit cigarettes.

DO NOT allow anyone to stand or jump on the mattress or box spring, as it is not manufactured to withstand that type of weight concentration or abuse.

DO NOT allow the mattress to get wet because some upholstery materials can compress. Protect the mattress from water or other liquids.

DO NOT remove the tag attached to the mattress. This tag serves as a means of identification to establish your eligibility to use the Limited Warranty.

DO NOT use any type of dry cleaning fluid on your mattress. These chemicals will damage some construction materials and void the Limited Warranty.

DO NOT place the mattress upside down, with the pillow part facing down.

These Limited Warranties do not apply to rental, commercial, business, institutional, or other non-residential uses. Limitations and exceptions

The following limitations and exceptions apply to the Limited Warranties:

  • Stains, dirt and burns on the fabric.
  • Side wires that follow the perimeter of the mattress or box spring, twisted due to movement or twisting.
  • Structural damage to the mattress caused by an inadequate frame or box spring.

The mattress must be permanently supported on a suitable box spring with a proper frame. The proper frame must fully support the box spring. These Limited Warranties apply to queen and king-size mattresses and box springs only when used with proper frames with rigid center support, at least five legs, and three cross slats.

  • A mattress or box spring that is not defective.
  • Normal body impressions on a memory foam or gel mattress that are less than three-quarters of an inch (3/4” or 1.90cm) deep.
  • Normal body impressions on a spring mattress less than one and a half inches (1½” or 3.8cm) deep.
  • The height of the bed with the mattress and box spring or frame fully assembled.
  • The mattress zipper cover is more than two (2) years after the purchase date.
  • Comfort preference.
  • Fitting the sheet.
  • Transportation costs.

ASHLEY SHALL NOT BE LIABLE FOR ANY EXTENDED OR ADDITIONAL WARRANTIES OFFERED BY ANY RETAILER OR THIRD PARTY UNDER ANY CIRCUMSTANCES. THE TERMS AND CONDITIONS SET FORTH IN THESE LIMITED WARRANTIES SHALL REPRESENT THE CONSUMER'S SOLE AND EXCLUSIVE REMEDY FOR A MANUFACTURING DEFECT DURING THE WARRANTY PERIOD. ASHLEY SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY OR RELATED DAMAGES, WHETHER DIRECT OR INDIRECT, WHETHER ARISING IN CONTRACT OR TORT.

Under no circumstances will Ashley be liable for any matter other than its sole obligation to repair or replace the product. Ashley's liability will not, under any circumstances, exceed the purchase price of the product or its replacement. THIS EXCLUSIVE REMEDY SHALL NOT BE DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE PROVIDED THAT ASHLEY IS WILLING AND ABLE TO REPAIR OR REPLACE ANY PRODUCT INSPECTED BY AN AUTHORIZED ASHLEY REPRESENTATIVE THAT IS FOUND TO HAVE A MATERIAL MANUFACTURING DEFECT DURING THE LIMITED WARRANTY PERIOD. Some states do not allow the exclusion or limitation of certain damages, so this limitation or exclusion may not apply to you.

IF YOU USE AN IMPROPER BOX SPRING OR FRAME WITH THIS MATTRESS, SUCH USE WILL VOID THESE LIMITED WARRANTIES. ASHLEY RESERVES ALL RIGHTS TO DISCONTINUE PRODUCTION OF ITS PRODUCTS AND TO CHANGE PRODUCT SPECIFICATIONS WITHOUT PRIOR NOTICE. Ashley does not guarantee the suitability of any of its products for individuals with medical conditions. Ashley makes no other warranties except as set forth in these Limited Warranties.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Claim process

If a problem arises that you believe is covered by these Limited Warranties, contact the authorized Ashley dealer where you purchased the product. All claims must include the original sales receipt, the product serial number, and the tag (affixed to the mattress and/or box spring) and must be filed within the applicable warranty period to qualify for the Limited Warranties. Ashley may request proof of the quality of the box spring used with the mattress. If necessary, the dealer will contact Ashley to arrange service. If the problem can be easily remedied, Ashley will authorize the dealer to make the repairs. Ashley reserves the right to require the return of defective parts upon request.
